Justin Gordon Lupski, age 30, has been charged with Aggravated Battery, Aggravated Assault, Flee & Elude and Obstructing without violence. He has been transported to the Lee County Jail. On May 26, 2013 at 7:03 p.m., Lee County sheriff's deputies responded to 18700 McGregor Boulevard along the Sanibel Causeway in reference to a violent altercation.
Two groups of beach goers had became involved in a series of verbal altercations during the course of the afternoon. One of the groups left the beach, however, two members of the group returned to the beach after retrieving a rifle. Upon their return, the two men confronted the men they had argued with earlier. Upon seeing the rifle, the other group armed themselves with weapons including a baseball bat, a knife and beer bottles. A physical fight ensued during which time the male armed with the rifle and a male from the other group began grappling and struggling for control of the rifle. The rifle fired causing a bullet to flatten a tire of a nearby vehicle.
A nearby deputy heard the rifle fire and ran to the scene to investigate. One of the suspects disregarded the deputy, ran to his vehicle and began to flee the scene. Deputies arriving to assist the first deputy on scene located the fleeing vehicle and attempted to stop it. The suspect rammed a marked patrol car and fled. A pursuit ensued and the suspect crashed his vehicle into a canal along a seawall near Iona Road and Anchorage Way. The suspect ran from the vehicle and swam to a nearby dock where deputies and K-9 Units apprehended him. The suspect was transported to a nearby hospital for medical treatment. Upon release from the hospital, the suspect will be arrested. He faces charges including Fleeing and Eluding a Law Enforcement Officer, Resisting Arrest without violence and Aggravated Assault with a Motor Vehicle.
